The General Terms and Conditions apply exclusively to registration for fitness courses conducted by AllStar Gym LP12 GmbH (ZONE4) or their helpers, which are booked via the AllStar Gym LP12 GmbH ZONE4 format website or app.

 

Health, and Training of Minors
The member declares in advance that they will have their physical fitness confirmed by a doctor. AllStar Gym LP12 GmbH (ZONE4) is not obliged to check or question the physical suitability of the member for the use of the studio before the conclusion of the membership contract or during the contract period. The member therefore undertakes to only use the studio facilities if they are physically able to do so.

For young people aged 16-18, training is possible with the written consent of the legal guardian.

 

General

The person participating in the events of the ZONE4 format fully accepts the house rules that are posted in the fitness club.

The instructions of the staff must be followed.

 

use of the premises

The participating person is permitted to use the wellness area of the All Star Gym fitness club as part of a visit to an event in the ZONE4 format, subject to availability.
The use of other offers of the All Star Gym, such as equipment park or courses, is not included.

Appointments and coordination
Appointments are binding via the website or app of the ZONE4 format of AllStar Gym LP12 GmbH or by telephone. To ensure the best course of training, we ask that you confirm or cancel your participation in good time (at least 12 hours before the start of the appointment via the website www.zone4.fit or via the ZONE4 app).
If there are less than 4 customer registrations 4 hours before the start, AllStar Gym LP12 GmbH (ZONE4) reserves the right to cancel the appointment. If an appointment cannot take place due to illness of the trainer or force majeure, e.g. a pandemic, AllStar Gym LP12 GmbH (ZONE4) will try to offer an alternative date; however, there is no legal entitlement to this.

Use of Images and Videos
The participant agrees that AllStar Gym LP12 GmbH (ZONE4) may publish photo and video material created during AllStar Gym LP12 GmbH (ZONE4) events. AllStar Gym LP12 GmbH (ZONE4) is also authorized to use these for advertising purposes. The consent can be revoked at any time.

Liability
In the event of slight negligence, AllStar Gym LP12 GmbH (ZONE4) is only liable in the event of a breach of essential contractual obligations (cardinal obligations), but in these cases the amount is limited to the damage that was foreseeable and typical for the contract at the time the contract was concluded, in the case of personal injury and in accordance with the Product Liability Act. Cardinal obligations are those obligations that make the proper execution of the contract possible and on compliance with which the member can regularly rely. Otherwise, the pre-contractual, contractual and non-contractual liability of AllStar Gym LP12 GmbH (ZONE4) is limited to intent and gross negligence. The above limitations of liability also apply in the event of the culpability of vicarious agents of AllStar Gym LP12 GmbH (ZONE4).
Damage to property in the fitness club will be remedied at the expense of the person who caused or caused it at least negligently.
AllStar Gym LP12 GmbH partially monitors its fitness club with video cameras and saves the recordings on a case-by-case basis to the extent and for as long as they are necessary for the safety of its members and the investigation of criminal offenses. The circumstance of the observation and the responsible body, as in the entrance area, are made recognizable by information signs. The relevant provisions of the Federal Data Protection Act are observed.

AllStar Gym LP12 GmbH (ZONE4) collects, stores, processes and uses personal information that it receives directly from the member or through the use of its facility. AllStar Gym LP12 GmbH (ZONE4) uses this information about the member to shape the customer relationship with the member and also to offer other own or third-party products. All advertising can be contradicted at any time.
To the extent permitted by law, AllStar Gym LP12 GmbH (ZONE4), its affiliated companies and those commissioned with the execution of the contract have access to the stored data. Any further transmission to third parties does not take place.

Final Provisions
Should parts of the contract be void or ineffective, the remaining provisions shall remain unaffected. In place of the ineffective or void provisions, the corresponding statutory law applies. Place of performance is Berlin.

If there are fewer than 4 customer registrations 4 hours before the start, AllStar Gym LP12 GmbH (ZONE4) reserves the right to cancel the appointment.
If an appointment cannot take place due to the trainer's illness or force majeure, such as a pandemic,
AllStar Gym LP12 GmbH (ZONE4) will try to offer a replacement appointment; however, there is no legal entitlement to this.

Use of images and videos
The participating person agrees that AllStar Gym LP12 GmbH (ZONE4) may publish and use photo and video material that is created during the events of AllStar Gym LP12 GmbH (ZONE4) for advertising purposes. The consent can be revoked at any time.

liability
AllStar Gym LP12 GmbH (ZONE4) is only liable for damages resulting from slight negligence in the case of damage to life, body or health or in the case of breach of essential contractual obligations (cardinal obligations). Cardinal obligations are those obligations the fulfillment of which is necessary for the proper execution of the contract and on the observance of which the contracting party regularly relies and may rely. In the event of a breach of cardinal obligations, AllStar Gym LP12 GmbH (ZONE4) is only liable for the foreseeable damages typical for the contract if there is no injury to life, body or health.
The liability for the slightly negligent breach of cardinal obligations is limited to the contractually typical, foreseeable damages. Any further liability is excluded.
The aforementioned limitations of liability also apply to the personal liability of the employees, representatives and vicarious agents of AllStar Gym LP12 GmbH (ZONE4).

Data protection
AllStar Gym LP12 GmbH (ZONE4) processes personal data of the participating person in accordance with the applicable data protection regulations.

Final provisions
If parts of the contract are invalid or ineffective, the remaining provisions shall remain unaffected. The corresponding statutory law shall apply in place of the invalid or ineffective provisions. The place of performance is Berlin.
